1. INTRODUCTION & MISSION

Welcome to ChataBok. Our platform is a “Safety-as-a-Service” environment designed specifically for minors aged 10-18 and their parents. By accessing or using our WordPress-based social networking plugin and website, you (the “User,” “Parent,” or “Guardian”) agree to comply with these Terms and Conditions. These terms incorporate our Privacy Policy, Anti-Bullying Policy, and Data Protection standards.

2. ELIGIBILITY & REGISTRATION

  • Parental Account: To use ChataBok, a Parent or legal guardian must first create an account. By doing so, you represent that you are at least 18 years of age.

  • Minor Enrollment: Parents are solely responsible for enrolling their children. You must provide an accurate Date of Birth (DOB) for each child to ensure they are placed in the appropriate Age-Based Room (10-12, 13-14, 15-16, 17-18).

  • Verification: ChataBok reserves the right to request proof of guardianship to comply with international safety standards.

3. DATA PROTECTION & PRIVACY (POPIA & COPPA)

ChataBok is committed to the highest standards of data privacy for minors.

  • POPIA Compliance (South Africa): We recognize children’s data as “Special Personal Information.” We process this data only to provide a safe chat environment. Data is stored securely and is never sold to third parties.

  • COPPA Compliance (USA): We do not collect personal information from children under 13 without verifiable parental consent. Parents have the right to review, delete, or refuse further collection of their child’s data.

  • Data Sovereignty: Users in Gauteng and across South Africa may exercise their right to access or delete their personal information by contacting our compliance officer via the website.

4. SAFE CHAT & ANTI-BULLYING POLICY

To maintain a protected space, ChataBok enforces a Zero-Tolerance Anti-Bullying Policy:

  • Prohibited Conduct: Users may not engage in harassment, “trolling,” hate speech, or the distribution of explicit content.

  • Banned Terms: Our system utilizes an automated monitoring engine. Messages containing “Banned Terms” will be blocked, and the “hit” will be logged for parental and admin review.

  • Privacy of Others: Users are strictly prohibited from sharing Personally Identifiable Information (PII), including phone numbers, home addresses, school names, or social media handles.

5. PARENTAL MONITORING & CONTROL

By using ChataBok, Parents and Children acknowledge and consent to the following:

  • Monitoring: All chat interactions and video uploads are subject to monitoring via the Parent Dashboard.

  • Suspension Power: Parents have the functional authority to disable their child’s chat access or suspend their account immediately through the plugin interface.

  • Admin Moderation: ChataBok “Group Admins” reserve the right to move users between rooms, issue bans, or report illegal activity to law enforcement (SAPS) if a safety threat is identified.

6. VIDEO CONTENT & INTELLECTUAL PROPERTY

  • Safety First: Video uploads must not contain sensitive location markers (e.g., street signs or school uniforms).

  • License: By uploading content to the ChataBok feed, you grant ChataBok a non-exclusive license to host and display the content within the secured platform for other verified users in your age group.

  • Reporting: Any video flagged for a safety violation will be moved to the Moderation Queue and hidden until reviewed by an admin.

7. SYSTEM USAGE & SECURITY

  • Account Security: You are responsible for maintaining the confidentiality of your login credentials.

  • Prohibited Actions: Any attempt to bypass age-gates, inject malicious code, or scrape data from ChataBok will result in an immediate permanent ban and potential legal action.

8. LIMITATION OF LIABILITY

ChataBok provides a platform equipped with safety tools (AI filtering, parental controls, and moderation). However, no system is 100% infallible. ChataBok, its owners, and developers are not liable for the individual conduct of users or any damages resulting from the use of the platform. Parents are encouraged to actively use the Parent Dashboard to supervise their children.

9. AMENDMENTS

We may update these terms to reflect new legal requirements or platform features. Continued use of the site after changes are posted constitutes acceptance of the new terms.
